{"id":1029,"date":"2026-01-15T10:30:00","date_gmt":"2026-01-15T08:30:00","guid":{"rendered":"https:\/\/somlea.nldsite.com\/?p=1029"},"modified":"2026-01-14T21:26:51","modified_gmt":"2026-01-14T19:26:51","slug":"urban-planning-cluj-napoca-landmark-legal-decision","status":"publish","type":"post","link":"https:\/\/somlea.ro\/en\/urban-planning-cluj-napoca-landmark-legal-decision\/","title":{"rendered":"\u0218OMLEA &amp; ASOCIA\u021aII obtains a landmark decision in urban planning matters in Cluj-Napoca"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">After three years of litigation and two rounds of proceedings, <strong><a href=\"http:\/\/somlea.ro\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u0218OMLEA &amp; ASOCIA\u021aII<\/a><\/strong> obtained before the Cluj Court of Appeal a <strong>partial annulment of the General Urban Plan (PUG)<\/strong> of Cluj-Napoca and a <strong>functional reclassification<\/strong> of the land belonging to the \u201cRecord\u201d complex, covering an area of <strong>7,985 square meters<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By <strong>Decision no. 175\/06.02.2019<\/strong>, the Cluj Court of Appeal dismissed the appeal filed by the <strong>Local Council of Cluj-Napoca Municipality<\/strong>, fully upholding the judgment of the Cluj County Court, which had partially annulled the General Urban Plan and ordered the reclassification of the land\u2019s functional use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"http:\/\/somlea.ro\/en\">\u0218OMLEA &amp; ASOCIA\u021aII<\/a><\/strong> represented the landowner, <strong>Trisom Record S.A.<\/strong> The team of lawyers included <strong>Radu \u0218omlea<\/strong>, coordinating partner, <strong>Elisabeta Popescu<\/strong>, senior partner, and <strong><a href=\"https:\/\/profesionisti.juridice.ro\/adrian-manole\" target=\"_blank\" rel=\"noreferrer noopener\">Adrian Manole<\/a><\/strong>, senior associate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Radu \u0218omlea:<\/strong> \u201c<em>This is an extraordinary decision, as it allows the development of an 8,000 sqm site located in the central area of the city. The 2014 General Urban Plan imposed a restrictive functional classification for that land, which blocked investment interest for five years. The mandate entrusted to us by Trisom Record S.A. and the result obtained confirm the quality of the legal services we provide.<\/em>\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Elisabeta Popescu:<\/strong> \u201c<em>It was a complex case, with extensive evidence, through which we demonstrated both the unlawful land-use classification provided in the PUG and the appropriateness of the new urban zoning, which was directly ordered by the court.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Adrian Manole:<\/strong> \u201c<em>Beyond urban planning aspects, the case also raised procedural challenges \u2014 the cherry on top being the rebuttal of a ground for annulment raised ex officio by the appellate court.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"http:\/\/somlea.ro\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u0218OMLEA &amp; ASOCIA\u021aII<\/a><\/strong> is a law firm based in Cluj-Napoca, associated since 2007 with <strong><a href=\"http:\/\/www.tuca.ro\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u021aUCA, ZB\u00c2RCEA &amp; ASOCIA\u021aII<\/a><\/strong>.
